Should I talk to the insurance adjustor?

No. Do not give a statement to the adjuster or sign any forms without consulting your personal injury attorney. Your lawyer will represent you in all dealings with the adjustor and, if a statement is to be given, your lawyer will be with you while you talk to the adjustor. Any information given about the facts and circumstances of your case can come back to haunt you at a later date. The insurance adjustor is not there to help you, but to save the insurance company money. Again, it is very important that you consult with an attorney before you agree to talk to an adjuster or before you sign any forms. When the insurance company calls, just tell them "you will have to talk to my lawyer", and they will call your attorney, leaving you alone.

What is the difference between uninsured motorist insurance and underinsured motorist insurance?

There are many different types of insurance that may help you in your case. Your attorney will analyze your situation to find out if you are entitled to more benefits than you think you are. If the person who hit you does not have enough insurance to cover your damages, we use your underinsured motorist insurance to get more money for you. If that person has no insurance, we use your uninsured motorist insurance to settle your claim. It is very important that you follow the advice of your attorney when dealing with uninsured or underinsured motorist insurance to avoid losing your right to recover from these types of insurance.

How much do I have to pay my attorney?

No Win/No Fee. In other words, we do not get paid until we recover a settlement for you. We take your case on a contingency basis and in most cases our fee is one third of the amount of money recovered from the insurance company. In Arkansas, you pay nothing unless you win money.

How can I get my medical bills paid?

The insurance company of the person who injured you will not pay any of your bills until you are ready to settle your case. We advise that you not settle your case until your doctor has released you from treatment. However, in many cases, your own car insurance will have coverage that will pay for your medical treatment. If not, you should use your own health insurance. After the case settles, your car insurance or your health insurance will be paid back from your settlement. This will allow you to continue to receive treatment from your doctors and keep your credit report free of any collection activity. If you do not have any type of insurance, some medical providers will work with your attorney to continue treatment by attaching a medical lien to your case so that they will be paid from your settlement. Before agreeing to such a lien, consult with your attorney to learn if there are any other options available to you.

My car was totaled and the adjuster won't give me a fair price. What can I do?

You do not have to take the first offer you get from the property adjuster. Remember, the adjuster is not trying to help you, but to spend as little money as possible. If you have photos of your car before the accident, you may want to share them with your adjuster. It is also helpful to have a good idea of what your car is really worth. Two websites we use are nada.com and kbb.com. Both of these sites use your zip code and the specifications of your car to give you a high and a low value. An adjuster will usually end up settling for an amount between the high and the low value. After you have refused the first offer, send the adjuster the values that support your counter offer.
